LAKE CHARLES – Charges are being dropped against a father accused of putting his nine-day-old son in freezer.

Calcasieu Parish prosecutors say they do not have enough evidence in the 2001 case to proceed, even though the child’s mother agreed to testify in a plea deal.

Tonguis and his wife, Amy, were both charged with first-degree murder. She pleaded guilty in 2002 to accessory after the fact in exchange for her testimony against her now-ex husband. Her sentencing was awaiting her testimony.

Tristan Tonguis was found dead in his parents’ freezer on Aug. 19, 2001.
