Board attorney Gerard Caswell on Monday filed a federal court motion to toss out Marion White’s bill for about $10 million in the 40-year case.
Caswell asserts White’s documentation to justify the hours on which the fee is base is inadequate, the fee is unreasonable and the alleged 14,000 or so hours include thousands unrelated to the case.
Judge Tucker Melancon will decide what fee, if any, White gets unless the sides reach an agreement to settle the matter.
The case itself ended in March.
Caswell argues that White’s request for $350 hour base rate times two because of the case complexity is out of line.
