West St. Mary Port commissioners hired special legal counsel Tuesday to safeguard zoning regulations on the port site.

After a 20-minute executive session, the commission returned to regular session.

Executive Director David Allain said the commission retained attorney John Mouton of Lafayette in reference to “any zoning issues we may have with Evangeline Cove Marina. The commission has asked that (Mouton) look into the ordinances that pertain to that issue.”

On Tuesday’s agenda, the port commission expected to hear from John Tesvich, who earlier this year approached the port regarding a marina on the port site. Tesvich filed an application for a coastal use permit with the Louisiana Department of Natural Resources to build the marina on Sunrise Road along the channel. The commission sent a resolution to DNR in December opposing the project, expressing misgivings about locating a recreational facility in an industrial site. Some port tenants also weighed in with their disapproval.

The permit has been approved by DNR.

Allain said Tesvich asked to be on the agenda “and we expected him to come with new news, but he didn’t show… there’s some zoning issues, and we’re making preparations.”

In other business Tuesday, Allain said the port was out of power for about a day due to Hurricane Isaac last week, and reported no substantial damages.
