Amendment 1 has brought about some confusion statewide regarding the intent and scope of the measure.
According to the Louisiana Public Affairs Research Council, “The amendment would prohibit the levy of new taxes or fees by state or local governments upon the sale or transfer of immovable property after November 30, 2011. It would not repeal taxes or fees currently levied.”
Only New Orleans imposes such a transaction tax. The amendment, according to PAR, would not affect ad valorem taxes “or general legal and real estate fees.”
Therefore, a “yes” vote will authorize prohibition of such taxes and fees, and a “no” vote will allow state and local governments to imppose them.
Polls will be open Saturday from 6 a.m. to 8 p.m.
